Terms of use

Read the privacy policy

1. About these terms

These terms govern your use of Nittaq, a Saudi Arabia-based platform that simplifies database setup and management. By submitting an account application or using the platform, you agree to these terms. You must be at least 18 and legally able to enter an agreement. If you act for an organisation, you confirm you have authority to bind it. A separately agreed service order takes precedence for the specific matters it covers.

2. Applications and account access

Account applications are reviewed manually to match demand with available capacity and understand each applicant’s requirements. A reference number confirms receipt; it does not confirm approval or reserve capacity. We may ask for clarification, defer admission or decline a request for capacity, security or service-fit reasons. Access begins only after approval and activation. Give accurate information, keep it updated and protect your password and connection keys. Tell us promptly if you suspect unauthorised access.

3. Service scope and availability

Features, resource limits, regions and support arrangements are those stated in your approved plan or service order. Custom-plan requests are enquiries until we agree an order. Maintenance, security incidents, provider interruptions and events beyond reasonable control can affect availability. An uptime commitment or response-time guarantee applies only if expressly agreed in writing. Our primary hosting direction is the Middle East; any particular residency requirement must be agreed before use.

4. Your data and connection keys

You retain ownership of your data. You grant us only the permission needed to host, process and transmit it to deliver the agreed service, provide support, maintain security and meet legal obligations. You are responsible for having the right to use your data, your application’s permissions, database schemas and lawful instructions. Keep connection keys in trusted server environments and maintain suitable independent backups. Do not submit passwords, database secrets or sensitive personal records in support or sales messages.

5. Acceptable use

Use the platform lawfully and within agreed resource limits. Do not distribute malware, infringe others’ rights, bypass access controls, attempt to access another customer’s data, disrupt the service or misrepresent your identity. Security testing requires our prior written permission for the agreed scope. You must meet any additional legal requirements that apply to your sector and data; contact us before using workloads requiring specific regulatory approval or contractual safeguards.

6. Fees and plan changes

Submitting an application, support request or custom-plan enquiry does not create a payment obligation. Charges, billing periods, applicable taxes, renewal, cancellation and any refund arrangements must be disclosed and agreed before a paid service starts. Changes to an existing paid commitment require the notice or agreement specified in your order and applicable law. We will not debit you solely because you submit a form or select a plan.

7. Platform rights

Nittaq and its licensors retain their rights in the platform, software, branding and documentation. During authorised access, you have a limited, non-exclusive right to use the service for your permitted purposes. You may not resell access, copy protected platform materials or use our name to imply endorsement without permission. This section does not transfer ownership of your data to us or restrict mandatory legal rights.

8. Suspension, closure and data retrieval

We may restrict or suspend access when reasonably necessary to address a material breach, security threat, unlawful activity, overdue agreed charges or binding legal requirement. We will use proportionate measures and give notice and a reasonable opportunity to resolve the issue where feasible. Immediate action may be necessary to protect the service or others. You may request closure by contacting us. Where lawful and technically feasible, we will coordinate an opportunity to retrieve your data before final deletion, subject to your order and the privacy policy.

9. Responsibility and liability

We exercise reasonable care in providing the service. To the extent permitted by law, we do not promise uninterrupted or error-free operation or suitability for every purpose. Subject to mandatory rights, our total contractual liability arising from the service is limited to the greater of SAR 1,000 or the fees you paid for the affected service in the preceding 12 months. This limit does not apply to fraud, wilful misconduct, gross negligence, liability for a harmful act where it cannot lawfully be limited, or any other liability or remedy that applicable law does not permit us to exclude or limit. Courts retain their statutory powers over compensation.

10. Changes and applicable law

We may update these terms as the service or legal requirements change. We publish the effective date and notify existing customers of material changes with reasonable advance notice where feasible. Changes do not retrospectively remove accrued rights or override an agreed order. Saudi Arabian law governs these terms, subject to mandatory protections that apply to you. Disputes may be raised with us first and remain subject to the competent courts in Saudi Arabia. An unenforceable provision does not affect the remaining terms.
